The following terms and conditions (“Terms”) apply to the rewards program (the “Program”) provided by Loyal Labs, Inc. (“Loyal” or “we”) and govern your participation in the Program. Terms do not extend to merchant, sites, partners, affiliates, or any other entities. Loyal is not responsible for merchant, sites, partners, affiliates, or any other entities terms, conditions, or other policies. By participating in the Program, you agree to be bound by these Terms.
1. Eligibility: The Program is available to all individuals who are legal residents of the United States and who are 18 years of age or older.
2. Earning Points: Members will earn points for eligible purchases made at participating merchants. Points are awarded based on the total amount of each eligible purchase, excluding taxes and shipping fees. The number of points earned per dollar spent may vary and is subject to change without notice. Points cannot be earned for the purchase of gift cards or other non-merchandise items.
3. Redeeming Points: Members can redeem their points for discounts on eligible purchases made at participating merchants. The number of points required to redeem a discount may vary and is subject to change without notice. Points cannot be redeemed for cash or transferred to another member’s account.
4. Expiration of Points: Points earned through the Program expire 24 months after they are earned. Expired points cannot be reinstated.
5. Changes and Termination: We reserve the right to modify, suspend, or terminate the Program at any time without prior notice. We also reserve the right to modify the terms and conditions of the Program at any time. In the event of termination, all points earned through the Program will be forfeited.
6. Limitation of Liability: We are not responsible for any errors, omissions, or malfunctions in the Program or for any loss or damage resulting from participation in the Program. Our liability is limited to the replacement of any points that are lost or not properly credited to a member’s account.
7. Ownership and Confidentiality: By participating in the Program, you acknowledge that all ownership and intellectual property rights in the Program and any related materials, including without limitation all software, technology, and trademarks, are owned by Loyal Labs, Inc. or its licensors, and that no use, license, or other rights are conveyed to you. You agree not to use, copy, modify, or distribute any information or materials related to the Program without the prior written consent of Loyal Labs, Inc. You also agree to keep all information related to the Program confidential, and not to disclose such information to any third party unless you have obtained the prior written approval of Loyal Labs, Inc.
8. Privacy: By participating in the Program, you acknowledge and consent to the collection, storage, and use of your personal information, including but not limited to your email address, phone number, and purchase data, by Loyal Labs, Inc. for the purpose of recommending products and services to you. Loyal Labs, Inc.’s use of your personal information is subject to its privacy policy, which can be found at https://www.joinloyal.com/privacy-policy. By participating in the Program, you agree to the terms of the privacy policy, which may be updated from time to time by Loyal Labs, Inc. You are responsible for reviewing the privacy policy periodically and staying informed about any changes. If you do not agree with the terms of the privacy policy, you should not participate in the Program.
9. Governing Law: These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of laws provisions.
10. Dispute Resolution: Any dispute or claim relating in any way to the Program will be resolved by binding arbitration, rather than in court. The Federal Arbitration Act and federal arbitration law apply to this agreement. There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages), and must follow the terms of these Terms as a court would.
By participating in the Program, you acknowledge that you have read and understood these Terms, and agree to be bound by them.
